Acceptable Use Policy

You may not publish or transmit through x10Hosting’s free web hosting service content that x10Hosting reasonably believes:

• Constitutes child pornography.
• Constitutes pornography.
• Is excessively violent, incites or threatens violence, or contains harassment or hate speech.
• Is unfair or deceptive under the consumer-protection laws of any jurisdiction, including chain letters and pyramid schemes.
• Is defamatory or violates another person’s privacy.
• Creates a risk to personal or public safety or health, compromises national security, or interferes with a law-enforcement investigation.
• Improperly exposes another person’s trade secrets or other confidential or proprietary information.
• Is intended to help others defeat technical copyright protections.
• Clearly infringes another person’s trademark, service mark, patent, or other property right.
• Promotes illegal drugs, violates export-control laws, or relates to illegal gambling or arms trafficking.
• Is otherwise illegal, or solicits conduct that is illegal under laws applicable to you or x10Hosting.
• Is otherwise malicious or fraudulent, or may cause retaliation against x10Hosting by offended viewers.

Content published or transmitted through an x10Hosting service includes website content, email, bulletin-board posts, chat, and any other posting or transmission that relies on an internet service provided by x10Hosting.

Customers are responsible for taking reasonable security precautions to protect login information for their services and the x10Hosting billing area. Customers are also responsible for the security of their websites and VPS services. x10Hosting is not responsible for compromised scripts or servers.

You must obtain x10Hosting’s advance approval before sending bulk commercial email. Approval will not be given unless you demonstrate all of the following to x10Hosting’s reasonable satisfaction:

• Intended recipients affirmatively consented to receive the email, such as through an opt-in process.
• The consent process includes reasonable measures to verify that the person consenting owns the email address.
• You retain evidence of each recipient’s consent in a form that can be produced promptly, and you honor requests from recipients or x10Hosting for that evidence within 72 hours.
• The email body explains how the address was obtained and how the recipient may request evidence of consent.
• Recipients can easily revoke consent, such as through a link in the email or instructions to reply with “Remove” in the subject line. Revocations must be honored within 72 hours, and recipients must be told that timeline.
• A privacy policy is posted for every domain associated with the mailing.
• You have a way to track anonymous complaints.
• You do not obscure the source of the email. The recipient’s email address must appear in the message body or the “To” line.
• You otherwise comply with the CAN-SPAM Act and other applicable law.

These requirements apply to messages sent through your x10Hosting service and to messages sent from any network by you, or by someone acting for you, that directly or indirectly direct recipients to a site hosted through your x10Hosting service. You may not use a third-party email service that does not apply similar procedures to all of its customers.

x10Hosting may test and monitor compliance with these requirements, including by requesting opt-in information from a random sample of a mailing list at any time.

You may not send unsolicited email, either in bulk or individually, to anyone who has indicated that they do not want to receive it.

You may not publish, distribute, or otherwise copy music, software, art, or another work protected by copyright law unless:

• The copyright owner has expressly authorized you to copy the work in that manner.
• Established United States copyright law otherwise permits you to copy the work in that manner.

Free web hosting accounts that violate the Terms of Service or this Acceptable Use Policy will be removed. x10Premium hosting users will usually be informed of a violation before action is taken, but accounts may be taken offline immediately in severe cases. x10Hosting management has full discretion to determine severity.

If you believe that someone using the x10Hosting network is infringing your copyright, send a written notice of infringement to the address below. The DMCA Policy also lists the designated agent’s email and voice contact.

Your notice must include:

• A physical or electronic signature of a person authorized to act for the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed, or a representative list if one notice covers multiple copyrighted works at one site.
• Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for x10Hosting to locate it.
• Information reasonably sufficient for x10Hosting to contact you, such as an address, telephone number, and, if available, an email address.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the owner’s agent, or the law.
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.

You must keep valid, current information on file with the domain-name registrar for every domain hosted on the x10Hosting network.

You may not engage in illegal, abusive, or irresponsible behavior, including:

• Accessing or using data, systems, or networks without authorization, including attempts to probe, scan, or test vulnerability or to breach security or authentication measures without the system or network owner’s express authorization.
• Monitoring data or traffic on a network or system without the owner’s authorization.
• Interfering with service to a user, host, or network, including mail bombing, flooding, deliberate overload attempts, and broadcast attacks.
• Using an internet account or computer without the owner’s authorization, including attempts to trick people into revealing passwords, password theft, security-hole scanning, and port scanning.
• Forging a TCP/IP packet header or any part of the header information in an email or newsgroup post.
• Conduct likely to cause retaliation against the x10Hosting network.
• Using the x10Hosting network in a way that unreasonably interferes with another customer’s use of the network.

You must follow the rules and conventions for posting to any bulletin board, chat group, or other forum in which you participate, including IRC and USENET groups and their rules for content and commercial posts. These groups commonly prohibit off-topic commercial messages and mass posting to multiple forums.

x10Hosting has no duty under this policy to monitor or police customer activity and disclaims responsibility for misuse of the x10Hosting network.
